Luca Rocco Magnotta butchered Jun Lin, 33 years old in Montreal, Canada, by decapitating him, dismembering him, stuffing his torso in a suitcase in the garbage and mailing a foot and a hand to the federal Conservative and Liberal parties; and for this, he will be charged with first degree murder. What a horror for all Canadians - or is it? But if Jun Lin had been 33 weeks old in the womb, and was killed before being extracted from his mother's womb, then he would not be charged with murdering Jun Lin; he would only be charged with assaulting the mother. This is according to Canada's law, s. 223(1).
Now Magnotta's defence lawyers could argue that he is being discriminated against according to the Canadian Charter of Rights not to be discriminated against on the basis of age. If he could kill a 33 week old Jun Lin in the womb with impunity then it would be discriminatory to prosecute him just because Jun Lin is 33 years old instead. Butchering is butchering whether it is a child or an adult. Welcome to Canada, ladies and gentlemen, and I use these appellations advisedly in this country where it is legal for any one of us to kill with impunity before 9 months of age when the child's residence is the pink womb instead of the child's blue bedroom.
